Permit Requirements: What to Know
Every jurisdiction writes its own rules, but across 7,000+ projects in all 50 states, we have found that the same five factors determine whether a permit is required. If any one of these applies to your project, plan on pulling a permit.
One more exemption worth knowing: replacing a structure with basically the same thing in the same spot — like a same-size deck — often doesn’t need a new permit. Rules still vary by city, so confirm with your building department.
- Size
The International Residential Code (IRC R105.2) exempts detached accessory structures under 200 square feet from building permits. Many cities adopt this threshold. Some still use the older 120 square feet limit. A few — like San Diego — go as high as 300 square feet for freestanding patio covers. The only way to know your threshold is to check with your building department. We can help with that.
- Attachment to the House
Any structure attached to your home — a pergola bolted to your exterior wall, a covered patio extension, a breezeway connecting the house to a freestanding pavilion — is almost universally treated as an addition. Your building department will want engineering showing that the ledger board connection can handle the added load. This comes up constantly: a “simple” attached pergola can trigger the same permit process as a room addition.
- Solid Roof vs. Open Roof
An open-rafter pergola and a solid-roof pavilion are different structures in the eyes of the building code. A solid roof creates wind uplift loads, snow loads, and water runoff patterns that an open pergola does not. Most jurisdictions classify solid-roof structures as patio covers under IRC Appendix H and require permits regardless of size. If your project has a roof — or if you plan to add one later — assume a permit is needed.
- Electrical
This one has no exceptions. If your project includes wiring of any kind — lighting, ceiling fans, outlets, heaters, a TV mount, or an integrated power system like our TimberVolt Power Post System — an electrical permit is required. This is separate from the building permit. You need both. The electrical permit requires a licensed electrician for the final connection, and the work gets its own inspection.
- Plumbing or Gas
An outdoor kitchen with a sink, ice maker, or any appliance requiring a water supply line needs a plumbing permit. A natural gas line to a built-in grill needs a gas permit. These are separate from the building permit and the electrical permit. A fully built-out outdoor kitchen under a pavilion could require three or four separate permits — building, electrical, plumbing, and gas. That sounds like a lot. It is not. They are all straightforward when the documentation is right.
How Different Structures Stack Up
Not all outdoor structures trigger the same requirements. Here is what we see across most jurisdictions — your city may vary, but this is the pattern.
Freestanding pergola, open roof, under 200 sq ft, no electrical:
Most likely exempt from a building permit. You still need to meet setback requirements. If you have an HOA, you still need their approval. This is the simplest permit scenario.
Freestanding pergola, open roof, over 200 sq ft, no electrical:
Building permit required in most jurisdictions. Engineering drawings and a site plan showing setbacks are typically needed. This is the most common scenario for WTF projects, and the documentation is something we handle as part of every kit.
Attached pergola, any size:
Building permit required. The attachment to your house makes this a structural modification. Engineering must show the connection can handle the load. Western Timber Frame runs the structural calculations in-house, and when a wet-stamped review is required, it’s handled by a licensed outside engineer for the state where you’re building.
Pavilion or gazebo with a solid roof:
Building permit required in nearly all jurisdictions, regardless of size. The solid roof triggers wind uplift and snow load requirements under IRC Appendix H. Engineering is not optional here — it is the difference between approval and rejection.
Outdoor kitchen under a pergola or pavilion:
Building permit plus separate electrical, plumbing, and/or gas permits depending on the utilities involved. This is the most documentation-heavy scenario, but also the most common for families building a full outdoor living space. We handle the structural engineering and construction drawings. The Engineering Behind a Permitted Structure
This is the part of the permit process that catches people off guard on cost, so it’s worth understanding up front.
Some building departments require a wet-stamped structural engineering review before they’ll approve a permitted outdoor structure. “Stamped” means a licensed Professional Engineer reviewed the design, verified it meets code for your specific site conditions — wind speed, snow load, soil type, seismic zone — and put their license on the line by signing the drawings.
Professional engineering licenses don’t transfer between states. An engineer licensed in Texas can’t stamp drawings for a project in Florida — each state requires its own licensure. Some online structure companies use a single engineer in one state and claim their plans are “accepted in most locations.” That sounds reassuring until your plans examiner sends them back because the stamp is from the wrong state. Now you’re hiring a local engineer out of pocket — $500 to $2,000 or more — to redo work you thought was already done.

It comes at an added cost, and we’ll always get your approval first. Outside engineering review is used only when it’s genuinely required, not as a default on every project.
If you’re evaluating any outdoor structure company — us or anyone else — ask this question: if my project needs a stamp, will it be from an engineer licensed in my state? If the answer is vague, that’s your answer.
Zoning vs. Building Permits — They Are Not the Same Thing
This catches people off guard more than anything. A building permit says your structure is safe. A zoning review says your structure is allowed where you want to put it. You may need both even if you are exempt from one.
Setbacks: The minimum distance your structure must be from property lines, the street, and other buildings. Typical residential setbacks are 5 to 15 feet from side and rear property lines. A 20×20 pavilion in a backyard with 5-foot setbacks might only have one spot where it legally fits.
Lot coverage: Many cities limit the total percentage of your lot that can be covered by structures — usually 40% to 60%. Your house, garage, shed, and any new outdoor structure all count. Going over the limit requires a variance, which is a separate process with its own timeline and fees.
Height limits: Most residential zones cap accessory structures at 15 feet. A standard WTF pergola or pavilion fits comfortably under this, but if you are building on a raised deck or elevated site, the measurement starts from grade — not from the deck surface.
HOA approval: Separate from everything above. Your HOA may have its own rules about materials, colors, placement, and even architectural style. Get HOA approval before ordering the structure. We have seen projects delayed months because the HOA review was left for last.
